These Terms of Service (“Terms”) govern your use of stayshaded.co.ukand the purchase of products from Shaded Ltd (“we”, “us”, “our”).

By using our website or placing an order, you agree to these Terms.

2. Products

We sell detachable awnings designed for sash windows.

All products are described as accurately as possible. However, slight variations in colour, materials, or dimensions may occur.

3. Orders

When you place an order:

  • You agree that all information provided is accurate

  • Orders are subject to availability and acceptance

  • We reserve the right to refuse or cancel any order

You will receive an order confirmation email once your order is accepted.

4. Pricing and payment

All prices are listed in GBP (£). We do not currently add VAT to our prices. If our VAT status changes, we will update these Terms and the pricing on our Site accordingly.

  • Payment is processed securely via Squarespace Payments. By placing an order, you also agree to comply with Squarespace’s terms and conditions.

  • We do not store your payment details

We reserve the right to change prices at any time.

5. Delivery

We aim to dispatch orders promptly. Delivery is carried out by third-party couriers (e.g. Royal Mail, DPD, Evri).

We are not responsible for delays caused by couriers, customs, or events outside our control.

6. Returns and refunds

You have the right to return your order within 14 days of delivery under the Consumer Contracts Regulations.

To be eligible for a return:

  • The item must be unused and in its original condition

  • You must contact us at info@stayshaded.co.uk before returning

Refunds will be processed within 14 days of receiving the returned item. Return shipping costs are the responsibility of the customer unless the item is faulty. This does not affect your statutory rights.

7. Faulty or damaged goods

We hand pack every product. But if your item arrives damaged or faulty, please contact us as soon as possible (ideally within 7 days) with photos.

We will offer a replacement, repair, or refund as appropriate.

8. Product use and installation

Our product is designed for use with sash windows and typical low-rise building conditions.

We have third-party tested the product for wind resistance and received a wind class rating of Class 2 which represents a safety wind pressure of 84 N/m2. This corresponds to a Beaufort 5 moderate breeze, or gusts of up to 24mph. In windy conditions that approach and exceed these stated limits, users should remove the awning. The product should not be used above 4 storeys where wind conditions may be stronger. Shaded Ltd accepts no liability for damage caused by extreme weather conditions, environmental factors, or use outside these intended conditions.

The awning fabric has had a fire-retardant coating applied during manufacture. This product is not a non-combustible or fire-rated structural material and must not be used as one. This product is designed solely for installation on low-rise residential buildings not exceeding 11 metres in height or 4 storeys, regardless of the floor on which it is installed. Installation on any building exceeding these dimensions is outside the intended use of this product and is expressly prohibited. Shaded Ltd accepts no liability for any loss, damage, enforcement action, or cost arising from installation of this product on a building that exceeds these limits. This restriction does not affect your statutory rights as a consumer.

Our products are not security devices and should not be relied upon to prevent intrusion or unauthorised access. By using this product, you acknowledge that your window may not fully close and that this may reduce security. You are responsible for determining whether the product is suitable for your property and security needs. The product should not be used on accessible windows (e.g. ground floor windows without a window restrictor in place). It is the customer’s responsibility to ensure the product is suitable for their specific window and security preferences, as well as installed correctly. Instructions are provided with your delivery and are available on our website here. We are not liable for any damage to property arising from improper installation or use of the product.

9. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect or consequential losses, including loss of profit, revenue, or data.

  • Our total liability to you for any claim arising out of or in connection with your order shall not exceed the amount you paid for the product.

  • We do not guarantee that our website will always be available, uninterrupted, or error-free.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any matter for which it would be unlawful to exclude or limit liability

10. Intellectual property

All content on this website, including images, text, and designs, is owned by or licensed to Shaded Ltd. You may not copy, reproduce, or use our content without permission.

The Shaded awning design is protected under patent number GB2600834.2 and design registration number 6520961.

11. Privacy

Your use of our website is also governed by our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
